Courts in Alabama apply a process known as equitable distribution to divide the assets and debts of the parties in a divorce case. Equitable does not mean equal. Rather, Alabama law requires that the assets and debts acquired by a couple during the course of a marriage be divided fairly between the parties.
Alabama divorce law intentionally does not establish specific standards regarding fairness. Rather, a judge is directed to distribute assets and debts on a case by case basis, based upon a close consideration of the specific circumstances of each couple.
